TERMS AND CONDITIONS OF CARRIAGE

 

I.     Services

 

CCX Courier (hereafter, "CCX") agrees to provide overnight and same day courier services to customers in accordance with the terms and conditions set forth herein and in accordance with CCX's published and specified rates.  CCX does not provide delivery services to post office boxes. 

 

II.    Payment

 

Customers shall pay in full for services rendered by CCX within seven (7) days of receipt of CCX's invoices which invoices are generally submitted no less frequently than monthly.  CCX reserves the right to impose an additional charge of 18% per annum (i.e., 1 1/2% per month) on outstanding balances that are more than thirty (30) days overdue.  Interest will be compounded and applied cumulatively for any month or portion thereof, where an outstanding balance remains.  CCX may at its option, add charges for services to the shipper's invoice for COD or collect shipment amounts for which the receiver refuses to pay CCX.

 

III.    Limitation of Liability

 

CCX will not be liable for special, incidental, or consequential damages relating to any carriage, including but not limited to lost income or profits, whether or not CCX had knowledge that such damages might be incurred.  CCX's liability with respect to damage from any carriage shall be limited to $100.

IV.   Shipment of Illegal or Hazardous Items

CCX reserves the right to decline the shipment of certain items, including but not limited to:  illegal goods, hazardous materials or hazardous substances.  It is the responsibility of the shipper to ensure that a shipment tendered to CCX does not violate any federal, state, or local laws or regulations.  CCX reserves the right to open or inspect any package tendered to it for shipment.

V.    Events Beyond CCX's Control

CCX will not be liable for loss, damage or delay caused by events CCX cannot control, including but not limited to acts of God, weather conditions, acts or omissions of public authorities including customs and health officials, and other events beyond CCX's control, which might delay, impair or prevent delivery.

VI.    Additional Charges

CCX's standard rates are based on the shipment of items that are less than 50 pounds.  For items that weigh 50 pounds or more, CCX's rates will be increased by $5 per each additional 100 pound increment, or portion thereof.  CCX imposes no waiting charge for the first 10 minutes that a carriage item is not ready for pick-up by CCX at the customer's scheduled pick-up time.  A waiting charge of $45 per hour, prorated to actual time, is charged thereafter. 

VII.   Claims

All claims regarding damages to, loss or delay of any shipment must be submitted in writing to CCX's office within 30 calendar days of delivery of the shipment; otherwise CCX reserves the right to refuse the claim.  CCX is not obligated to act on any claim until the customer has paid all transportation charges and the customer may not deduct the amount of the claim from those charges.
